Florida caution: under Fla. Stat. § 709.2108, a power of attorney executed after October 1, 2011 that is contingent on a future event (a “springing” power) is generally ineffective in Florida. You may still generate this draft for review, but a durable power of attorney is strongly recommended for Florida principals. Discuss with your attorney before executing.
