When to talk to a lawyer instead. Durable Power of Attorney

Effective immediately upon execution and NOT terminated by your later incapacity. Under the Uniform Power of Attorney Act, a power of attorney is durable by default unless it states otherwise.

Springing Power of Attorney

Takes effect only upon your incapacity, as certified in writing by physician(s). Nothing is granted while you retain capacity.

Florida notice: under Fla. Stat. § 709.2108, a power of attorney executed after October 1, 2011 that is contingent on a future event (a “springing” power) is generally ineffective in Florida. That is a statement of the statute, not advice about your situation — you may still generate this draft, but consult a Florida-licensed attorney about which type of instrument meets your needs before executing anything.
